Ten months after the death of a 22 -year -old gym trainer in Haridwar, Uttarakhand, his family was led to murder, a court has ordered an FIR against six officers.

A 22 -year -old gym trainer was Wasim On August 25, found dead in a pond in Madhopur in the districtWhile the family alleged that the police killed him, the police had said that he drowned in the pond after jumping, he was allegedly transporting beef. Despite the family complaint, an FIR was not registered.

Chief Judicial Magistrate Avinash Kumar Srivastava on Wednesday ordered an FIR and inquiry against six officers, working on the application by Aladdin, a relative of Wasim.

According to Alauddin’s application, Wasim was going home in the early hours of August 25, when he was stopped by sub-inspector Sar Singh, Constable Sunil Saini and Praveen Saini and three other unidentified police personnel.

The application said, “They started beating with sticks and baton with the intention of killing him and threw him near the pond near the road.” The application claims that on hearing his cry, the local people watched the incident and recorded a video of it.

“When he tried to save Wasim, the police threatened to shoot him when he intervened. Finally, police officers killed Wasim,” the application said.

Alauddin further said that the next day, he presented a written complaint to the Gangahar police station and a general diary entry was registered.

However, through its investigation report, the police claimed that the person riding a scooter ran away after seeing the police.

“When the police investigated the vehicle, they allegedly found a beef packet in the storage of the scooter. A large crowd gathered at the scene, including applicants Alauddin and his relatives who surrounded the police, threatened them, threatened, and accused them of beating and shooting them.”

Police claimed that the post-mortem concluded that the cause of death was sinking and breathing, and injuries on her body were caused by an effect with a difficult object. The missing lower lip was attributed to cutting from a pangasius fish.

Citing an order from the Supreme Court, the court said that the magistrate does not need to determine whether the complaint is false, but will have to assess whether the original elements of the alleged crime are present on a simple reading of the complaint.

Saying that the postmortem report showed six injuries on the body before the death, it shows that Wasim was badly beaten before throwing it into the pond, the court said the investigation report confirmed that the accused police personnel were present in the scene of the incident.

“Therefore, it cannot be ignored that the accused may have defeated Wasim and thrown him into the pond. The applicant has also submitted a report of Wasim’s inquiry as part of the case file, stating that the injuries were present on the body of the deceased.

Based on the investigation report, the court said, it has been concluded that registration of an FIR and proper investigation against the accused is required, as adequate evidence can only be collected through investigation.

SHO of Gangahar Police Station has been directed to file an FIR against sub-inspector Sar Singh, Constable Sunil Saini and Praveen Saini, and three unidentified police personnel, and to ensure that a copy of the FIR is presented to this court within 24 hours.
The court also asked the Senior Superintendent of Police to ensure that the investigation is done by a circle officer-rank officer from Haridwar headquarters.
