The NGO, Association for Democratic Reforms (ADR), has approached the Supreme Court challenging the Election Commission’s ‘Special Intensive Amendment of Election Rolls’ in Bihar, said it unconstitutionally, saying that it will separate millions from voters.
“The current writ petition has been filed under Article 32 of the Constitution of India, seeking to establish the order and communication on 24.06.2025 issued by the Election Commission of India (ECI). The registration of voters’ registrations 21A, 1960,” said.
It states that if the order was not separated, “… (this) can distinguish millions of its representatives from arbitrary and without any process, which can disrupt independent and fair elections and democracy in the country, which are part of the basic structure of the Constitution”.
It argued that “the documentation requirements of the instructions, along with the lack of the fixed process, improperly for the said less time … amendment … further is bound to obligate the practice to remove the names of millions from the electoral rolls, which is leading to their disintegration”.
According to the EC order of June 24, the Bihar electoral role will be prepared with a role as the basis of 2003. All 7.8 crore voters of the state will have to fill the calculation forms. While those who were on 2003 rolls-4.96 crore voters would not need to provide any additional documents, after 2003 voters-2.93 crore people-will have to give their own and their parents’ date and/or in place of proof of birth.
In its petition, the ADR stated that the June 24 order “has shifted the cause of citizens from the state being in the list of voters. It has excluded the identity documents like Aadhaar or Ration Card which makes them more vulnerable to excluding exclusion from the communities and poor voting”.
The petition stated that the announcement is required under the special intensive modification process, a violation of Article 326, “So far a voter needs to provide documents to prove his citizenship and also has the citizenship of her/her mother or father, which will not be linked to her name.

The petition said that the Election Commission has issued a “unfair and impractical timeline” to conduct special intensive amendments in Bihar, so about the state elections which are scheduled to be held in November 2025. “There are millions of citizens (whose names are not seen in 2003) even within the time period,” said.
It is indicating that “Bihar is a state with high poverty and migration rate, where there is a lack of access to documents such as birth certificate or parents’ records,” said that “said” more than 3 crore voters and especially from marginalized communities (such as SC, ST and migrant workers) may be excluded from voting due to strict needs “.
The writ petition stated, “The current reports of Bihar, where the heads are already running, suggests that lakhs of voters of villages and marginalized communities do not have officers of documents, as are being sought for them.”
The NGO said that Section 21 (3), 1950 of the Representation of the People’s Act has allowed ECI to “direct the reasons for the reasons for the recording of the electoral roll, but the instructions for Bihar have been presented arbitrarily and are responsible for coming down”.

The argument states that “while Sir or any other states of the country are a positive step, but the way ECI has directed Sir’s conduct in the pole bound state like Bihar, has questioned all stakeholders, especially voters”.
The NGO said that the Special Summary Amendment (SSR) was already held between October 29, 2024 and January 6, 2025 and addressed issues such as migration and unqualified voters due to death or other causes and “Thus, there is no reason for such rigorous practice in such an election that the right to vote for voters.
