In view of the dispute over his stay at the official residence beyond the permissible time, former Chief Justice of India Dye Chandrachud on Monday approved the air, saying that his luggage has been packed and he would soon go to a paid government house with his wife and children.
Chandrachud, his wife Kalpanna and daughters Priyanka and Mahi are both disabled persons, living in the official CJI residence of 5, Krishna Menon Marg, New Delhi.
Justice Chandrachud said in detail on the reasons of his overstay at the bungalow, “We have actually packed our luggage. Our luggage has already been packed completely. Some goods have already gone into a new house and some have been kept in storeroom here.”
The 50th CJI, who supervised the office on November 8, 2024, was responding to the communication of the Supreme Court administration to the Center to vacate the official bungalow due to the alleged oversete.
The former CJI emphasized the controversy and mentioned the medical condition of his daughters, who needed a wheelchair -friendly house.

“I will not tell you how I feel, but you can imagine how I feel about it … One thing I would like to mention that we are the parents of two children, Priyanka and Mahi. They are special children and they have special requirements. They have a situation called Memline Myopathy … and you know, it is a very rare gonesty disorder that affects a very rare gonesty.” He said, “Even at home, we maintain a high level of cleanliness, cleanliness and we have a very specific nurse that takes care of them. So now it’s a few days, or not for a few days, but perhaps the most in a few weeks. Justice Chandrachud remembered his elder daughter Priyanka in 2021 and in January, 2022 for 44 days in Chandigarh.
“And you know, when we were on leave in Shimla, she had difficulty, and she is actually really attached to a tracheostomy tube …” he said.

The former CJI described its children’s regular chest, respiratory and neurological therapy as different from pain and speech management.
He said that one of the children had difficulty swallowing as a multi-disciplinary team, which saw both her children on a daily basis.
Justice Chandrachud referred to former CJIS Justice UU Lalit and NV Ramana and other apex court judges, saying that they too were given the time expanded to stay in their official residences.
“And the important thing is that this expansion of time has been given not only to me but also to other judges like Justice UU Lalit, who retired as CJI and he was given a house after his retirement in Safdarjung Road and Justice NV Raman was given a house by the government on Tughlaq Road after his retirement, he said.

He said that various other judges were also given time extension of time or an expansion of time due to a personal problem.
The former CJI also ensures that their daughters are not exposed to dust or allergies or any kind of infection.
Justice Chandrachud said that he was “not the first to be allotted the House by the government” and claimed that the expansion of the time was the conscience of the Chief Justice of India.
Referring to the sequence of incidents, Justice Chandrachud said that after his retirement he then spoke to CG Sanjeev Khanna, who made him successful, and told him that he was to return to the 14, Tughlaq Road bungalow where he lived before becoming a CJI.

Justice Khanna, however, asked Justice Chandrachud to continue living in the CJI bungalow as the former did not want to reside.
On 1 July, the Apex Court Administration wrote to the Center, saying that Justice Chandrachud stayed in the CJI bungalow beyond the permissible period and demanded the evacuation of the property.
In communication sent to Housing and Urban Affairs (Mohua), Apex Court Administration said that the nominated residence for the Chief Justice of India should be returned to the court’s residence pool, said sources.
The letter requested the Mohua Secretary that he was allowed not only for the retention of the housing ending on 31 May without any other delay to capture the bungalow from the former CJI, but was also given a period of six months to survive on May 10 under the 2022 rules ending May 10.

Under Rule 3B of Supreme Court Judges (Amendment) Rules, 2022, India’s retired Chief Justice Type VII bungalow, a level below 5, Krishna Menon Marg Bungalow, a maximum of six months after six months can maintain for retirement.
