Offensive social media posts against PM Modi, RSS: Cartoonist transferred SC for anticipatory bail

The Supreme Court on Friday agreed to listen to the anticipatory bail argument of Indore-based cartoonist accused of uploading “objectionable” cartoons of Prime Minister Narendra Modi and RSS workers on social media.

A bench of Justice Sudhanshu Dhulia and Jomalya Bagchi agreed to hear on July 14, a petition filed by Hemant Malaviya challenged the order of the Madhya Pradesh High Court, in which lawyer Vrinda Grover immediately sought a hearing in the matter. On 3 July, the High Court refused to grant anticipatory bail to Malavia.
In May, an FIR was lodged against Malavia at Lasudia police station in Indore in May on the complaint of local lawyer and Rashtriya Swayamsev Sangh activist Vinay Joshi.

Malavia hurt the religious sentiments of Hindus and harass communal harmony by uploading objectionable materials on social media, stating in the complaint.
The FIR referred to various “objectionable” posts, including alleged inappropriate comments on Lord Shiva as well as cartoons, videos, photos and comments about Modi, RSS workers and others.

Malavia’s counsel before the High Court has said that he has posted only one cartoon, but he cannot be held responsible for the comments posted on it by other Facebook users.

The FIR accused him of posting abusive and objectionable materials with the intention of hurting the religious sentiments of Hindus and tarnishing the RSS image.
