The Supreme Court on Friday pulled the Center and Maharashtra government not to make courts for cases under special methods.
A bench of Justices Surya Kant and Joylya Bagchi said in its order: “If the Authority fails to establish courts with the infrastructure expected to conduct quick testing under the NIA Act and other special laws, the court will always be forced to release the accused on bail …”
The bench convened Additional Solicitor General Rajkumar Bhaskar Thackeray present for the Center and the Government of Maharashtra, that the existing courts were named as special courts and were given the High Court to “force” to relate them.
The bench said, “No effective or visible steps have been taken to set up special courts for rapid testing in cases under the NIA Act and other special laws. It goes without saying that the establishment of special courts will require the construction of posts for better judicial officers, employees, courts and basic facilities.”
The court said that an assumption was formed that the designation of an existing court as a special court would be adequate compliance with its instructions.

The bench said, “We are rejecting this petition taken by the respondents (Central and Maharashtra government).”
