The NHRC criticized the police investigation, saying that “the police failed to take cognizance of the fact that the current FIR is related to the treatment given by a fake doctor, not medical negligence. The police should start an investigation instead of waiting for the investigation report.”
The Commission said, “Presenting suspected documents, the absence of a verification qualification/license and allowing an unqualified person to practice not only as a doctor, but also the threat to life is also a serious negligence to perform important surgery and there is a serious violation of statutory duties by CMHO (Chief Medical and Health Officer of the Chief Medical and Health Officer of the Madhyadhari Pradesh).”
The report revealed that Yadav had falsely claimed to be an alumnus of North Bengal Medical College, and the institution refused the claim.
The NHRC report has also alleged that the management of Damoh Hospital where he worked, continued to engage in fraud activities for years without any proper inspection. “The accused had been running a hospital for several years. However, it is clear that no attempt was made by the CMHO, Damoh to verify the degrees and registration of doctors and the degree and registration. Obviously, no inspection was done before the current complaint was filed,” the report said.

The report said that the hospital allegedly has another doctor Dr. Akhilesh Dubey’s credibility was misused to obtain a license for his cath lab without his consent. The report also alleged serious irregularities in the implementation of Ayushman Government of India sponsored Health Insurance Scheme in the hospital. It said that the hospital systematically misused the scheme by “issuing fraud bills for treatment”.
Families of patients were forced to pay sufficient amount despite alleged Ayushman Bharat card. The report stated, “In many cases, the patient was forced to pay Rs 2,15,000 (Rs 2,80,000) for allegedly an angiography and other procedures, and even the Ayushman Bharat card was taken at the time of admission, however, no money or much less money was returned to family members.”
The NHRC has directed the Madhya Pradesh government to register separate FIRs and compensate the families of those who allegedly died after being treated by a fake cardiologist.
