An application seeking registration of an FIR against the news channels was filed by Advocate Sheikh Mohammad Salim, who claimed that the news channels not only displayed his name and picture, which portrayed him as a late terrorist, but was also associated with the 2019 Pulwama terror attack.

Referring to the SHO report that the family members of the deceased had not complained and the news was broadcast from Delhi, the judge said that no person, including public enthusiastic citizens, had no legal strip with knowledge of crime to initiate such action.

The judge said that the second dispute of the SHO regarding the regional jurisdiction in view of the broadcast arising from Delhi also fails in the light of Section 199BN, which provides that when an Act and its consequences are in different places, the jurisdiction arises at any place, the judge said. In the current case, the result of broadcasting – defamation, emotional injury and public unrest occurred in Poonach, where the deceased resided, served and martyred, he said.

Earlier, Iqbal’s family members had given legal notice through both news channels through Advocate Sheikh Shakeel Ahmed, seeking losses of Rs 5 crore every 5 crore rupees.
