SC provides protection to cartoonist

The Supreme Court on Tuesday granted anticipatory bail to Madhya Pradesh -based cartoonist Hemant Malavia, which was booked to share objectionable materials targeting Prime Minister Narendra Modi and RSS, when he agreed to remove them and apologize.

A bench of Justices Sudhanshu Dhulia and Arvind Kumar, however, said that one of his posts was “very, very aggressive”.

After beating such conduct, Justice Dhulia said, “What is happening today … all kinds of statements are being made. The language they use. The lawyers are doing anything in the community.”

Malavia had approached the SC, challenging the order of the Madhya Pradesh High Court, refusing anticipatory bail in the case.

Malavia was booked after a complaint filed by a Vijay Joshi, alleging that his Facebook profile had images, videos and comments that were deliberately posted to incite hatred against the RSS.

Joshi alleged that the posts also include objectionable, aggressive and derogatory cartoons, which target PM Modi and RSS volunteers.

The complainant alleged that aggressive comments were also made for religious sentiments.

“The intention behind the Act appears to riot the RSS workers and society, take the law into their own hands, engage in violence and disrupt public system,” Joshi alleged.
