The Urban Development Department of the Government of Himachal Pradesh has postponed the reservation roster for the urban local body elections later this year, creating a strong response from the State Election Commission, it has been learned.

Except for all the deputy commissioners of the state, leaving Lahaul and Speti and Kinnur, the notification said, “Accordingly, you are directed to take more necessary action in this regard and ensure that the reservation of seats for the upcoming urban local bodies (ULB) elections has not been issued and no it has been implemented.
The notification was issued on 10 July. On the same day, the State Election Commission (SEC) took action and issued a new notification. Himachal Pradesh Municipal Act, 1994 and Section 2 (30) and Himachal Pradesh Municipal Corporation Act, 1994 read with Section 2 (1) of the Municipal Corporation Act, 1994, cited “Claus (G) of Article 243p (G) of Constitutional India, the notification signed by the Secretary, State Election Commission said that” the relevant population has been used as a population.
Addressing the Chief Secretary, Government of Himachal Pradesh, SEC notification said that “the latest population data of Census 2011 will be relevant and valid for reservation of seats during the upcoming elections”. “It is appropriate to mention here that under Section 201 of Himachal Pradesh Municipal Corporation Act, 1994, the Superintendent for delimitation, reservation and allocation of wards by Rotation West in the State Election Commission, Nothing for” Urban Development “for the delimitation, reservation and allocation of wards by Rotation West, Section 9 of the Municipal Corporation of Municipal Corporation Act, 1994.
Urban Development Minister Vikramaditya Singh was unavailable for a comment.
Legal experts biased with SEC. “The Urban Development Department related to the secretary has shifted its powers. Whatever he did was illegal and unconstitutional. It would not test the judicial inquiry as it is to incite the mandate of a constitutional body,” said Senior Advocate, Shubash Sharma in the Himachal Pradesh High Court.

Reacting to development, former state BJP president Satpal Singh Satti said, “Congress leaders continue to play with copies of the Constitution in their hands, but interfere with the functioning of constitutional bodies. They keep a hue and cry on reservation, but will not reserve seats for SC, STS and OBCs in the upcoming urban local bodies.”
Elections of all municipal bodies of the state are to be held later this year except Shimla Municipal Corporation.
