Telangana gives HC government to decide on the end of the 21 -week pregnancy of a minor rape victim in a week

The Telangana High Court on Tuesday directed the State Government and the Superintendent of Gandhi Hospital in Hyderabad to immediately set up a medical board to see a rape victim’s 21 -week pregnancy treatment request and informed the court of his opinion within a week.

Justice K Sarath ordered a petition filed by NGO Prajwala, demanding the direction of the court for immediate and comprehensive tests on the 17 -year -old rape victim.

The NGO demanded examinations to prepare an opinion under the medical termination of the Pregnancy (MTP) Act 1971 in the presence of a qualified surgeon, gynecologist and maternity specialist. As soon as possible, seeking the end of pregnancy, the NGO gave a serious risk to the health of the pregnancy to the girl’s health.

It was presented that the girl was rescued from a brothel and a court order was admitted to Prajwala’s house for such victims for rehabilitation and during a regular medical examination, it was revealed that she was pregnant. The NGO also said that the girl wants to end pregnancy and does not want to end it.

Senior advocate Deepak Mishra, who appeared on behalf of Prajwala, argued that forcing a small prey of sexual abuse and smuggling to continue pregnancy, according to the MTP Act, his mental health would be severely damaged. He insisted that the minor is legally entitled to end his pregnancy if it creates a serious risk for his physical and mental welfare.

“Under Section 3 of the MTP Act, pregnancy can be eliminated for more than 20 weeks of pregnancy and for more than 20 weeks, a medical board, which should be agreed and agreed. And Section 6 of the MTP Act states that if a person is a minor, sex worker or rape, they can go for the end even after 20 weeks.”

He further argued that the minor victim is entitled to expiry if it causes serious injury to his physical and mental health.
