Tamil Nadu, after directing his arrest in the kidnapping case by the Madras High Court, questioned the suspension of Tamil Nadu Additional Director General of Police (ADGP) HM Jairam, the Supreme Court on Wednesday asked the state whether it would withdraw the suspension.
A bench of Justices Ujjal Bhuyan and Manmohan also directed the High Court order to be “shocking” the arrest of the police officer.
“Such orders are really shocking,” said Justice Bhuyan.
Jairam has been accused of abolishing kidnapping By allowing a minor boy to use his vehicle by a group of people who demanded to forcibly separate an inter-caste couple.
The boy is the brother of the man who married a woman of a separate caste despite his family opposition.
On Wednesday, the Tamil Nadu counsel informed the bench that Jairam was not arrested.
“If he is not arrested, why are you suspended?” Asked Justice Bhuyan.

ADGP counsel said he was kept in custody for 24 hours.
Justice Bhuan said, “You get instructions … (Whether you are ready) withdraw the suspension order. He is a senior police officer. Additional DGP is rank.”
The state counsel said Jairam had joined the investigation.
“So if he has joined the investigation, where it is Suspension question“Justice asked Bhuyan,” you can’t do that. This is very humiliating. ,

Justice Bhuan told the state counsel, “You get instructions. We will take it tomorrow … Why should he suffer?”
Justice Manmohan also expressed his displeasure with the order of the High Court and said, “I have been a judge for 18 years. I did not know that I had these powers … We never had the power to arrest.”
The bench said in its order, “The lawyer for the petitioner informed that the petitioner was issued at around 5 pm yesterday. However, he was placed under suspension. The state counsel, on the other hand, the petitioner was not arrested and he has joined the investigation. With a quarry by the court, he will motivate him to order suspension order.
The benches will listen to the matter again on Thursday.

Justice P Velmurugan asked Tamil Nadu Police to take ADGP In custody and proceeding according to law, commenting that public servants like him were “accountable to the public” and a strong message should go out that “no one is above the law”.
Jairam was detained after the court came out of the building.
The court, which was hearing the anticipatory bail plea of Murthy in the afternoon session, refrained the MLA from giving any relief and instead directed him to fully cooperate in the investigation.
The judge warned that strict action would be followed if the MLA failed to do so.
